LOAN NOTE & SECURITY AGREEMENT
For Value Received, the undersigned jointly and severally promise to pay the order of the Lender, the total of payments are disclosed, in installments of the amounts and upon the dates shown in the agreement. In the event that any installment payment under the Not is not paid in full within 5days following its scheduled due date. a Delinquency Charge (less the maintenance fee) will be assessed equal to Five (5.00%) percent of the unpaid installment amount or $15.00 whichever is greater. This Delinquency Charge shall not be collected more than once to the same default. There will be a onetime handling charge, not to exceed Thirty dollars ($30.00) and cost if a check is returned due to insufficient funds, Stop payment order or closed account
If you default on your loan you agree to pay all cost of collection including collection agency expense. If an attorney is employed to collect any amount in default on this loan. you agree to pay reasonable and actual attorney fees. plus, court cost if applicable. You also agree to repay for any cost you incur in the repossession, storage, or sale of the collateral.
On loans where the total loan is less than $100.00 refunds of interest will be calculated by the rule of the anticipation at nominal rate charted. On loans where the total amount of the loan is $100.00 or more, refunds of interest, disability insurance premiums, single interest automobile, involuntary unemployment, decreasing credit live and single property coverage insurance premiums will be calculated by the rule of 78. Refunds on maintenance fee and other insurance premiums will be calculated on a pro-rate basis on amount of loan. No prepayment refunds of less than one dollar ($1.00) need be made. All charges shall be refunded if the entire loan is repaid within three (3) business days
This contract complies with Tennessee Code Annotated, section 45-5-301 and all related sections mentioned within Any amount remaining unpaid after the maturity date of this note shall bear interest at the Maximum effective rate allowed according to Tennessee Code Annotated, section 45-5-401(c)
